I can confirm that. I just ran into it on a freshly dist-upgraded
server with aptitude-robot:

# aptitude-robot

And on the commandline manually (with an obvious example):

~ → aptitude -s install apt:
This code path should not be reached (now implemented in cmdline_mark)

No packages will be installed, upgraded, or removed.
0 packages upgraded, 0 newly installed, 0 to remove and 0 not
upgraded.
Need to get 0 B of archives. After unpacking 0 B will be used.
Would download/install/remove packages.
