When I boot up either 2.6.2 or 2.6.3 version of the kernel when it is
the same version as I previously shutdown with then "/etc/init.d/alsa
start" works without problem.  

As soon as I shutdown with one version of the kernel and start up with 
another (in either direction) the restore fails and is reported to have
done so by /etc/init.d/alsa start.

You can restore to a working state by running alsamixer and unmuting
lots of things that are shown as muted.

It appears that there is some incompatibilty between the asound.state
file between the versions
