boinc app milkyway, removing from unstable?

Hi Boinc developers, while looking to update milkyway sources I noticed a file with NVIDIA eula copyright

Copyright: 1993-2010 NVIDIA Corporation.
Files: nbody/src/nbody_gl_particle_texture.cpp
License:
  Please refer to the NVIDIA end user license agreement (EULA) associated



This file in my opinion makes the program distributable only in non-free, I opened an upstream issue [1]


what is your opinion? Just let it go?
