Hmm, I cannot reproduce this at all with either sarge (4.34-4sarge1)
or the semi-official backport for woody (4.34-4amwoody1).

$ cat /tmp/testmail
mail from:ametzler@localhost
rcpt to:ametzler@localhost
data
blah
.
quit
$ /usr/sbin/exim4 -bhc 12.13.14.15 < /tmp/testmail  2>&1 | grep -i acl
>>> using ACL "acl_check_rcpt"
>>> check !acl = acl_whitelist_local_deny
>>> using ACL "acl_whitelist_local_deny"
>>> end of ACL "acl_whitelist_local_deny": implicit DENY
>>> check !acl = acl_whitelist_local_deny
>>> using ACL "acl_whitelist_local_deny"
>>> end of ACL "acl_whitelist_local_deny": implicit DENY
>>> using ACL "acl_check_data"

What does
exim4 -bV
and
exim4 -bP acl_smtp_data
say?
