Yes, they are (non-free). But a typical solution for such cases is to
provide an installer in Debian that does not contain the data files, but
fetches the required files from public locations and installs them on
your system (cf. Doom, Quake II).

The package itself is totally free, it only contains debian scripting.
The reason why we don't want to put it in Debian itself is because we
are thinking on a better way to package the files: providing the
possibility to create and use FREE data files on the one hand and
allowing users to e.g. install Urban Terror (a total conversion) without
the need to install the Quake III data files (tested that already, it
works).
