Citing that article:

In another article Playboy stated that at the moment they have no interest
to take actions against people who infringe their copyright, because they
want to exploit the cult around that picture.
But they let their lawyers contact others before that talk mentioned above
and might do that again later. So to be on the safe side I think it is
better for Debian to not distribute that picture, not even in non-free.
