I don't really understand what you mean here.

"passwd -e" can only be issued by root. 

So either the expired user is logged in...and (s)he will continue
his/her session until (s)he logs out...and will then be prevented to
log in

Or (s)he's not log in and (s)he will not be able to log in anymore.

Where's the bug? Or do I miss something?
