Reviewing again #354899 it seems to me that Junichi is right. To quote the
license again:

Contributing back to upstream is a request, but it is also a _condition_ (as
spelled above) and this is mandatory and unavoidable condition to use, copy,
modify, and so on ... that software. These conditions are unavoidable and if
the copyright holders are so scrupulous they should already reconsider their
license and removed any ambiguity found it or use a already proven free
software license. I'm personally afraid to touch such "free" bits which
suddenly become non-free at some future point and/or exotic jurisdiction.
