It doesn't matter.  We gave users the promise that they can disable update-grub
by editing /etc/kernel-img.conf.  Many decided to hand-craft their menu.lst
based on that.

Well, then the situation for Ubuntu is different, and perhaps the decision
that is wrong here would be correct there.  But then again, this is not
very relevant to this bug report.

The purpose of shipping Legacy GRUB as a non-default bootloader would be, to
allow existing installations maintain their (possibly complex) setup without
having to deal with a GRUB migration at the same time they upgrade to lenny.

Redesigning the way update-grub works doesn't fit well with this purpose.
