This is plainly wrong.

Don't confuse distributing ZFS in source code form and distributing it
in binary form.

What Conservancy said is that they think that distributing ZFS in binary
form [1] is a violation of the GLPv2.

They never said that distributing ZFS as a DKMS package (source-code
only) was a violation of the GPLv2.

Ubuntu is distributing ZoL in binary form (binary modules already
built), but we aren't.
We never intended to distribute ZoL in binary form. We only want to
distribute ZoL as a DKMS source-code package.
