Probably right, but the 2.6.25 kernels in debian now have xen support
enabled (32bit x86 that is, the others do not). As a result the nvidia
driver had to be patched to not be confused by this.
I have no idea why you are getting a permission error.
What does this show:
ls -ld /usr/src/modules/nvidia-kernel/debian/patches/
